According to analysts, the decision should not be seen as a signal of what the outcome may be for Yoon's part, since Han is not considered to have played a key role in the introduction of the state of emergency.

Opposition leader Lee Jae-Myung told the media on Monday that the decision regarding Han "should be respected", but at the same time urged the court to expedite the case against Yoon.

Yoon is charged with leading a suspected attempt at a coup in South Korea, after he declared martial law in the country on December 3 and sent the military to parliament.

Han denies the allegations and has insisted that as head of state, he has the authority to introduce martial law.

Yoon was arrested in a large police operation on January 15, after he had refused to appear before the authorities for two weeks and instead barricaded himself in his residence.

In the criminal trial, a guilty verdict can lead to a maximum sentence of life imprisonment or the death penalty.
