The 60-year-old man entered his tenant's room, sniffed his underwear, put on his clothes, and then filmed himself masturbating.
The 60-year-old is now being convicted of trespassing – but is acquitted of sexual harassment, reports Kristianstadsbladet.
The incident was revealed when the man forgot his filming phone in the room, and it was later found by the Italian exchange student who rented the room.
The student reported the landlord to the police and attached a recording as evidence. However, despite the filming, the man is acquitted of sexual harassment, but is convicted of trespassing. According to the court, the act "did not involve physical contact or any action that can be equated with physical contact", writes the district court in its verdict.
It is also not proven that the 60-year-old "had the intention of harassing the plaintiff, who was not in the room".
