Sawing the Court of Appeal's verdict: "Gross procedural error"

The Court of Appeal acquitted a man who was prosecuted for gross unauthorized handling of confidential information. Now the Prosecutor-General (RÅ) is appealing, believing that the Court of Appeal committed a gross judicial error in its assessment.

The case involves a man who owned and administered a web forum where images and other sensitive information about defense facilities were spread.

He was sentenced to 3.5 years in prison by the district court, but was recently acquitted by the Court of Appeal for Western Sweden, which did not consider the information to be secret.

However, the Prosecutor-General Katarina Johansson Welin believes that the Court of Appeal focused on the wrong things and did not examine whether the man handled secret information or not.

In her appeal, the Prosecutor-General writes that in her opinion, this constitutes "a gross procedural error that can be assumed to have affected the outcome of the case."

"I request that the Supreme Court set aside the Court of Appeal's judgment and send the case back to the Court of Appeal for re-examination," says Johansson Welin in a press release.
