An employer must be able to demonstrate economic capability to employ a seasonal worker in order to obtain a permit from the Migration Agency, according to the Migration Court of Appeal.
The assessment of the employer's ability to manage salary costs is part of the financial capability that, according to law, must be assessed prior to permit issuance.
"The assessment of financial capability shall include an evaluation of the employer's economic capability to employ seasonal workers", the court writes in a press release.
Eva Gullfeldt, Councilor of the Administrative Court of Appeal, clarifies:
"The assessment of financial capability shall be made in the same way, regardless of the type of work permit being assessed. The purpose of the assessment is, among other things, to prevent potential abuse", she says according to the press release.
