The man was prosecuted for having a shotgun in his home without a permit. The man says in the interrogation that he found the gun during a dog walk in the forest and that he took it home because there were playing children nearby. He then allegedly put the weapon away in a closet in his apartment and forgot about it.
When he, after about a year, took out the weapon, he accidentally shot himself in the foot – he had to amputate a toe and has continued suffering from the shot.
Falu District Court assessed the penalty value to eight months' imprisonment. Since the man consented to community service, the sentence was instead a conditional sentence and 200 hours of community service.
However, the Svea Court of Appeal increased the sentence to two years and three months' imprisonment due to aggravating circumstances – the man's partner was at home at the time and he had consumed alcohol during the day – but since he was injured by the shot, three months were deducted. Thus, the man was sentenced to two years' imprisonment.
