A man who was sentenced to eight years in prison for child rape and simulated drowning has been granted a retrial in the Supreme Court. The prosecutor who led the case was biased.
The man was convicted of multiple rapes against a then 13-year-old girl and also for assaulting her with a baton and through simulated drowning, reports Kristianstadsbladet.
He has also been convicted of torture-like violence against his former employees. They were also subjected to simulated drowning, as well as other violent acts, according to previous verdicts.
The reason why the prosecutor is considered biased is that she had worked at a law firm just a year before becoming the lead investigator in the case, and one of her former colleagues at the firm was the plaintiff's assistant in the case of the rapes and assault.
"Since it is not clear that the bias did not affect the outcome of the case, a retrial has been granted. The case will now be taken up again by the Court of Appeal", writes the Supreme Court on its website.
