The proposal on minimum wages contravenes EU law, writes the Advocate General in a statement.
The message thus follows the line of Sweden and Denmark, which have demanded that the EU Court of Justice repeal the directive from 2022, as they claim that the EU lacks the mandate to make decisions on wages.
Denmark was the first to formally appeal the EU decision. In the spring of 2023, the Swedish government followed suit.

Both trade unions and employer organizations have been strongly opposed to the EU interfering with wage formation. However, in negotiations with the EU, Sweden managed to secure several exemptions from the EU's decision on minimum wages.
The Advocate General's statement is not legally binding, but usually carries significant weight when the EU Court of Justice makes a decision.
