Risk of the death penalty, torture or other degrading treatment in the home country is an example of circumstances that make it impossible to deport a person. This also applies if the person has been sentenced to deportation due to a crime, has been classified as a security threat or is suspected of serious crimes in their home country.
Today, a time-limited residence permit for one year is granted when the person cannot be deported. This includes a work permit, registration, certain benefits, and the opportunity to travel within the EU. Unreasonable, thinks the government, which has appointed the inquiry that was submitted to the Minister of Migration today.
Now we're making sure to implement changes that should have been in place for several years, says Minister of Migration Johan Forssell (M).
Simplify Deportation
Instead of granting temporary residence permits, the deportations will be temporarily stopped, "inhibited". The Migration Agency will also prepare for a deportation during the inhibition period.
At the same time, the benefits that the person is entitled to in Sweden will be limited to daily allowance at the same level as asylum seekers and the right to certain healthcare.
It has a strong signal value that these individuals are not given access to the welfare society in the same way as law-abiding citizens should have, says Johan Forssell.
According to the proposal, the individuals may be required to report to the Migration Agency or the police and may be prohibited from leaving the county where they are to live. Accommodation will be assigned by the Migration Agency.
Over 300 People
Last year, this group consisted of 340 people in Sweden, according to the Migration Agency.
How long these individuals will be able to live with temporary enforcement obstacles in such a situation, investigator Dag Stegeland cannot answer.
It's impossible to say. A temporary enforcement obstacle is something that is reviewed successively year after year. As soon as an opportunity to enforce arises, it should be taken, he says.
In what way will Sweden become safer with these proposals?
We will have better control over the individuals who have committed crimes or have shown that they can commit crimes in Sweden, says Stegeland.
The proposals are presented a year and a half after the Migration Agency's then-director-general Mikael Ribbenvik submitted a request for a legislative amendment. They are proposed to come into force in 2026.
