On Friday, Democratic Governor Kathy Hochul repealed a over 100-year-old law that meant unfaithful individuals could be punished with up to three months' imprisonment.
These questions should definitely be handled by the individuals concerned and not by our criminal justice system, says Hochul.
Let's strike this silly, outdated law from the books, once and for all.
In practice, the outdated law has been used very sparingly. Over the past 50 years, it has led to a dozen prosecutions and five convictions. The last time someone was investigated for infidelity was in 2010, when a woman was arrested during a sex act in a park in New York. The case was, however, dropped.
The now scrapped law was introduced in 1907, likely to make it harder to get a divorce during a time when proven infidelity was the only way to separate legally.
