The Court of Appeal reduces the sentence from nine to three years' imprisonment for the stabbing outside a café in Kristianstad in August last year. The District Court had also sentenced the defendant to deportation, but now the Court of Appeal has come to the conclusion that he should not be deported, writes Kristianstadsbladet.
The man who was stabbed suffered life-threatening injuries in the attack, according to the District Court's verdict, which convicted the defendant of attempted murder.
However, the Court of Appeal believes that it has not been entirely possible to establish that the injuries were life-threatening. It has also not been proven that the 28-year-old defendant was intent on killing the 36-year-old who was hit by the knife in the shoulder. Therefore, he is instead convicted of assault.
