The boy was hit when he was cycling and trying to cross a pedestrian crossing in Märsta, north of Stockholm, on June 7, 2023. He was severely injured and later died.
According to prosecutor Daniel Suneson, the 28-year-old who drove the car, which according to the police is part of a criminal network in Märsta, was negligent in connection with the collision.
Suneson argued, among other things, that the man drove too fast and did not pay sufficient attention to other road users.
"A greater degree of caution is required at an unguarded pedestrian crossing, and he has caused the boy's death through the collision," said Suneson in a press release in connection with the indictment.
However, the Attunda District Court does not believe that the prosecutor has been able to prove that the man, who was driving with his headlights off, was negligent. The 28-year-old is acquitted of both causing another person's death and reckless driving.
"From the investigation in the case, the court has not been able to determine what it looked like from the direction the boy was coming from on his bicycle. It has also not been possible to say with certainty that the man did not adjust his speed to the conditions at the location," says judge Karl Axel Öberg in a comment.
