It was in December last year that the now 17-year-old boy uploaded a clip on Tiktok with the title "what are the helicopter robbers doing now?".
In the clip, the name and picture of a man who was claimed to have participated in the notorious robbery of a vault in southern Stockholm were shown. The man who was exposed shared a name with one of the robbers, but had nothing to do with the crime.
The boy was prosecuted for gross defamation. In court, the exposed man told that he had been contacted by people who had seen the clip and recognized him, and that he had been afflicted with sleep disorders.
According to the boy, he was made aware that he had exposed the wrong person – but did not want to remove the video because it got so many views, which "became like an addiction". In the end, however, he did so on a friend's advice.
The District Court considered that the penalty value for an adult corresponded to a shorter prison sentence and sentenced the boy to 30 hours of youth service for gross defamation.
The boy appealed to the Court of Appeal, which considers that the penalty value rather corresponds to a fine and reduces the penalty to 20 hours of youth service and 20,000 kronor in damages.
