More than before made marital status investigations during January, February, and March this year. In March, the Tax Authority received over 6,000 applications for marital status investigations, the highest figure for the month since 2022.

Prenuptial agreements, which are to be registered with the Tax Authority, do not match the wedding frenzy. There, the figure is 1,087 in January to slowly increase to 1,335 in June.

A "dealbreaker"

But according to a survey conducted by Verian on behalf of Familjens Jurist, the prenuptial agreement is something that can be crucial for the relationship. 17 percent, almost every fifth person, think that it would be a "dealbreaker" if the partner does not accept writing a prenuptial agreement. Among people who have previously separated or divorced, the figure is even higher - 28 percent.

The figures do not surprise Pierre Kryhl, senior lawyer at Familjens Jurist. That the issue can be sensitive, he notices when he meets couples who come to write a will and the prenuptial agreement is mentioned.

Then you can notice that it becomes quite sensitive and difficult for them, and you understand that they need to go home and discuss a bit.

Affects inheritance

If you think it feels unlikely that love will one day end, you can be quite sure that life will. A prenuptial agreement can, for example, affect inheritance.

If someone has a child from before, I think it's wise to think about it, because it affects what the children will inherit and how it will be distributed.

Pierre Kryhl describes the prenuptial agreement as an on/off switch for marital rights.

Marital rights are per default on when you get married, so that in practice you share half of the net assets on each side. The prenuptial agreement is an opportunity to turn it off - either regarding everything or specific specified property.

A prenuptial agreement is an agreement on what should be separate property in a marriage. It can be written at any time during a marriage or before it.

Separate property is not included in any future division of property. What is not separate property is called marital property.

You can decide for yourself how extensive the prenuptial agreement should be. It is also possible to change it afterwards by writing a new one.

A prenuptial agreement must be drawn up in writing, dated, and signed by the spouses. It must be sent to the Tax Authority for registration.
