The man was convicted by the district court of aggravated drunk driving after driving a light truck with 0.59 mg/l of alcohol in his breath, reports Dagens Juridik.
Now the Court of Appeal has overturned the verdict and acquitted the man. The reason: he was reportedly asleep at the time.
Among other things, the man submitted a statement from a neurologist stating that he is "a so-called sleepwalker."
Even though the man did not mention being asleep at the time of his arrest, the Court of Appeal concluded it was not proven beyond reasonable doubt that he intended to drive while drunk.
