The woman applied for an exemption from shore protection for the construction of a pier in 2018 and was approved by Värmdö Municipality. The decision was reviewed by the County Administrative Board in Stockholm, where the case remained pending for one year and eleven months before being taken up.
In total, it took two years and eight months to get a decision.
The woman then sued the state for violating the European Convention and for failing to examine the case within a reasonable time. The case went to the Supreme Court, which now states that although the case was inactive at the County Administrative Board for far longer than acceptable, it was nevertheless decided within a reasonable time.
"The State has not been found guilty of a violation of Article 6(1) of the European Convention," the court writes.
