Swedish Legislative Council: Social assistance ceiling may clash with children's rights

The Government needs to conduct a more thorough analysis of how the proposed subsidy cap aligns with the UN Convention on the Rights of the Child, the Legal Council believes.

The government wants to introduce a ceiling on social assistance. Part of this involves families with many children or people without a residence permit being able to have their social assistance reduced. The government wants to use this to encourage parents to look for work, but critics have argued that reduced support will have an impact on children.

The Legislative Council, which reviews the government's proposals before they become bills in the Riksdag, believes that the benefit ceiling must be further clarified and assessed against the Convention on the Rights of the Child. The convention became Swedish law in 2020 and means, among other things, that the best interests of children must be taken into account, for example when laws are written.
