A child in Kronoberg born through a surrogate mother in the USA was denied Swedish citizenship by the Tax Authority – despite the egg coming from a Swedish woman.
The Administrative Court, however, gives the mother and the right and now demands that the Tax Authority reconsiders the decision, reports P4 Kronoberg.
The Tax Authority did not consider the child to be a Swedish citizen since it was born in the USA. The Administrative Court, however, believes that a court ruling in the USA has established that the Swedish woman is the child's mother and that the child should therefore be considered a Swedish citizen from birth.
