Supreme Court Sentences Man for Rape at LSS Facility

The Supreme Court overturns the court of appeal's verdict that acquitted a man who was convicted of raping an intellectually disabled woman at an LSS residential facility. The man is sentenced to two years' imprisonment.

The man, who was employed at an LSS residence, was sentenced last year in the district court to five years' imprisonment and damages of over 700,000 kronor for several rapes of a resident.

The verdict was appealed and the man was acquitted in the Court of Appeal, which did not consider the woman to be in a particularly vulnerable position since the man claimed they had a romantic relationship.

The Supreme Court quashed the acquittal and established that the woman could not have participated in the sexual acts due to her intellectual disability. She also had several other diagnoses and was therefore in a particularly vulnerable position.

The Supreme Court, however, assessed the crimes as less serious and reduced the sentence to two years' imprisonment and damages of 430,000 kronor.
