Court Upholds Murder Conviction in Mikael's Shooting

Mohammed Mohammed who shot 39-year-old Mikael in a pedestrian tunnel in Skärholmen claims that the shots were fired by mistake. But that is not accepted by Svea Court of Appeal, which upholds the murder conviction. It is ruled out that the shots have been fired by mistake, says the judge.

In March, the 19-year-old Mohammed Mohammed was sentenced to 14 years in prison for murder in Södertörns District Court – the harshest punishment under the law, since he was not of age at the time of the crime. The Court of Appeal confirms the verdict in its entirety.

In the Court of Appeal, he has spoken more than he did during the trial in the District Court. He now admits that it was he who shot, but claims that it was not his intention and that it was Mikael who took hold of the gun during a fight and that the shots then went off.

“Excluded”

But the Court of Appeal dismisses the explanation.

Despite being suspected of a serious crime for a longer period of time, he has not been able to answer the question of why he first in the Court of Appeal tells that it was an accident, says Court of Appeal Assessor Erik Lindberg at a press conference.

The story of an accident is also contradicted by the investigation, the Court of Appeal believes.

The firing pin had to be pressed in for each individual shot and some force is required. It is excluded that the shots were fired by mistake, says Erik Lindberg.

Shot after confrontation

Lindberg also mentions the fact that Mikael was under the influence of alcohol at the time – a fact that has received a lot of attention.

I want to be clear that these circumstances were known early in the investigation. It may possibly be an explanation for why Mikael approached, but it does not affect the assessment, he says.

It was on April 10 last year that 39-year-old Mikael was shot to death in front of his son after he confronted a group of young people, including the murderer.

The two convictions for attempted murder against rival gang members in 2023, which Mohammed was also convicted of, also stand.

The Court of Appeal's verdict also includes another person who is again convicted of grossly shielding a criminal with the punishment of youth supervision for seven months.
