Setback for Humana - damages claim denied

Three years ago, the Swedish Health and Social Care Inspectorate (Ivo) revoked Humana Assistans' permit to provide personal assistance, home care and services with companions and relief staff. The reason was deficiencies in its operations and that the assistance company did not comply with applicable laws.

Humana appealed the decision to the Administrative Court and sued the state for almost a quarter of a billion kronor. The Administrative Court found that it was unclear whether Humana was unsuitable, and Ivo's decision was overturned.

Now the district court has rejected Humana's claim for damages. The district court was not tasked with reviewing Ivo's decision. According to the district court, however, Ivo's decision cannot be considered wrong or to give rise to damages. Humana has not yet announced whether it will appeal the judgment.
