The incident is said to have taken place at an address in Örebro between 6 p.m. on Saturday and 2:16 a.m. on Sunday. Since a police officer is suspected of a crime, the investigation is being led by the Special Prosecutor's Office.
"In the court's opinion, there are probable grounds for the normal degree of assault. It was the court's assessment that detention would be disproportionate in summary," says Per Nichols, chief prosecutor and head of the preliminary investigation in the case, to Nerikes Allehanda .
The prosecutor chose on Tuesday afternoon to appeal the decision.
"I can't go into the details for investigative reasons, but I think the grounds for detention still exist. Now it will be up to the Court of Appeal to review it," he tells the newspaper.
