The court is now overturning a decision by the EU Intellectual Property Office (EUIPO) following a complaint from the French publisher Les Éditions Albert René.
The publisher holds the rights to the comic books about Asterix and Obelix and protested strongly when the EUIPO previously approved the use of "Obelix" as a trademark for weapons. The court has now ruled in their favor.
"A brand's reputation must be assessed taking into account all factors," the court said.
Asterix was created by the duo Albert Uderzo and René Goscinny, who together made 24 comic books about the brave Gauls. Since then, another 17 books have been published, some by other cartoonists and writers.
