Government contribution freeze proposal may violate individual property rights

The Council on Legal Affairs believes the government's proposal to freeze benefits for social insurance recipients may conflict with fundamental legal principles and the protection of individual property rights.

The Law Council wants the government to conduct a more thorough analysis of the proposal. Otherwise, it is not possible to assess how it "relates to the legal order in general and to the requirements of legal certainty," write the three senior lawyers on the Law Council.

Under the government's proposal, a person who has ever provided incorrect information important to an earned pension would, according to the Law Council's reading of the government's legal referral, have their pension blocked for between three months and three years. It would not be possible to have the pension paid out retrospectively.

The Law Council is not convinced the proposal can be reconciled with the protection of individual property.
