A process is now underway to get the country to change its mind about the controversial constitutional amendments that were pushed through in September.
According to the amendment, it will be up to Slovak authorities to decide whether and when EU decisions will apply in Slovakia – including rulings in EU courts.
"This is contrary to the principle of the primacy of EU law, which is a fundamental part of the EU legal order," states a press release from the Commission.
Slovakia now initially has two months to defend itself.
