In any case, this is the opinion of one of the EU Court of Justice's Advocates General in their proposal for a judgment regarding the dispute over Italy's outsourcing of its migration management.

Italy hopes to accommodate migrants and refugees in camps in Albania while waiting to determine whether they can stay or not. However, the system has been questioned following appeals concerning two individuals from Bangladesh, who claim that Italy made a mistake when their country was declared safe enough to permit deportation.

The Advocate General's proposal opens up the possibility for Italy to continue the operation, while emphasizing that only countries with "democratic systems" where the majority of inhabitants are protected can be defined as safe.

A definitive judgment from the court is expected at the earliest by the end of May. The process is being closely followed by several other EU countries interested in similar systems.
