The fatal accident during filming occurred in 2014 when camera assistant Sarah Jones was killed by a train when the film team was filming on a railway bridge without permission.

Miller served a year in prison in Georgia. In 2021, he was prosecuted for violating his ten-year probation, which, among other things, prohibited him from directing, by directing the film "Coffee Wars".

The purpose of Miller's new lawsuit against DGA is to have his lifetime ban from 2022 lifted. The ban prevents him in practice from directing films with unionized employees.

Miller claims in the lawsuit that the ban was made in bad faith, under pressure from the union to which Sarah Jones belonged, IATSE. He also claims that the DGA leadership manipulated the voting in the ethics committee, which initially voted unanimously for him to be allowed to stay – until four out of five members changed their minds after a meeting with the union leadership.
