Mother-in-law acquitted of murder – but husband convicted

Last year, a 27-year-old mother of two was murdered in Eskilstuna. The Svea Court of Appeal has now upheld the district court's life sentence against her husband - but acquitted the mother-in-law.

In the district court, the man was sentenced to life imprisonment for murder, and the Court of Appeal is now upholding that sentence.

However, the man's mother – the 27-year-old woman's mother-in-law – is acquitted. In the district court, she was sentenced to life imprisonment for instigation of the murder, but the Court of Appeal overturns that sentence as, according to the court, there is no evidence that she was involved.

The district court also sentenced the husband's brother to a long prison sentence for, among other things, aiding and abetting murder. The Court of Appeal also acquitted him of complicity in the murder and instead sentenced him to three years in prison for aggravated protection of a criminal.

A number of other family members are also acquitted by the Court of Appeal for their involvement in the murder.

The district court considered it proven that the murder was honor-related. The Svea Court of Appeal makes a different assessment, even though it is seen that there are some who speak for honor motives and that there have been views on how the woman lived her life. However, there is no clear investigation that proves that it was an honor killing, according to the Court of Appeal.

"Instead, most of the evidence points to the husband, who had been controlling and violent during the marriage, becoming angry and jealous when he realized that the woman had met a new man and that this led to the murder," says Court of Appeal Councillor Kerstin Elserth in a comment.
