29-year-old Kilmar Abrego Garcia, who lives in the state of Maryland, was one of over 200 migrants deported by the Trump administration on March 15 – accused of belonging to a criminal gang.
Abrego Garcia's lawyers have categorically denied that he belongs to a gang, he has not been charged or convicted of a crime. He has lived in the USA with protected status since a judge decided that he can be harmed if he returns to his home country.
The Justice Department has admitted that Abrego Garcia, who is married to an American citizen, was deported due to an "administrative error", but claimed that it is too late to do anything about it.
A federal judge announced last week that the 29-year-old should be brought back to the USA by Monday at the latest, as he was detained "without legal grounds" and then deported "without further process or legal justification". The government appealed the decision, which the Supreme Court has now upheld.
