Erik Helgeson was given notice in February, citing, among other things, violations of the Security Protection Act. The dismissal led to several port strikes, where the union, among other things, demanded better protection for elected officials.
The final examination of the main issues – whether there was a violation of the right to association and whether there were objective reasons for termination – will be decided at a later date, but then only regarding damages instead of return to work.
The AD's ruling was not unanimous.
"Our vice chairman has been dismissed due to his union work, an obvious violation of the right to association. It is not up to the employer to decide how we organize ourselves or who represents the collective, but Erik will of course remain and work in his assignments in the future," says Martin Berg, chairman of the Port Workers' Union, in a press release.
