In June, a 17-year-old boy was sentenced for raping a girl in a school toilet in Lycksele. Now the court of appeal is overturning the verdict and the boy is being acquitted, reports P4 Västerbotten.

The court of appeal motivates the verdict by saying that so-called tjatsex is not punishable, according to SVT Västerbotten. The girl is supposed to have followed the boy and agreed to have intercourse, even though she actually did not want to.

When you give in even though you deep down do not want to and you are not exposed to violence, threats or coercion, it is not a rape, says court of appeal judge Linda Ferry to SVT Västerbotten.

The boy's sentence in the district court was one year of youth supervision and damages to the girl.
