The man, who is 19 today but was 16 at the time of the incident, is however convicted of two cases of narcotics offenses and minor narcotics offenses.
It was at a party in February 2023 that the 14-year-old and her friend took tramadol and drank alcohol. She fell asleep later in her bed, but never woke up. The 19-year-old has admitted to selling the tablets but denied causing her death.
According to Falu District Court, the decisive issue in the case was whether the 14-year-old had sufficient opportunities to take responsibility for herself and her health.
Here, the court mentions, among other things, that the tablets were sold in a package where the dose was indicated, that she had asked about the strength before the purchase, and that she had experience of trying narcotic preparations and had also previously used tramadol. Furthermore, she had searched the internet about the risks of tramadol together with alcohol and her friends had warned her during the evening about combining it with alcohol.
"All this means that the district court cannot come to any other conclusion than that the 14-year-old girl must be considered to have had sufficient opportunities to take responsibility for herself and her health when she ingested the tramadol tablets," says the court's chairman Johan Rosén according to a press release.
The 19-year-old is sentenced to probation and community service.
