Sweden Makes Holocaust Denial a Constitutional Offence from 2027

Holocaust denial will now also be criminalized as incitement against an ethnic group under the Freedom of the Press Act and the Fundamental Law on Freedom of Expression. The constitutional amendment will enter into force on January 1, 2027.

The Riksdag decision means that the constitution will explicitly state that incitement against an ethnic group is also a violation of freedom of the press and freedom of expression if it involves denying a genocide or crime against humanity that has been established by a Swedish or international court.

Holocaust denial can already be punished under the Criminal Code if it constitutes incitement against an ethnic group.

The constitutional amendment is considered particularly important for addressing hate propaganda and incitement against an ethnic group online, where publication can in certain cases be protected by the Freedom of the Press Ordinance.

The constitutional amendment requires two Riksdag decisions, with a parliamentary election in between. This was the second decision.
