The victim, a 22-year-old man, was shot with multiple shots to the head and back inside a restaurant in the Marielund district on November 27, 2023. The lone shooter fled the scene and has not been identified by the police.
The 22-year-old was taken to hospital but later died.
According to the police, the murder is linked to an ongoing gang conflict in Norrköping, where the murdered man and the two accused men belong to rival sides.
According to the prosecutor, the two men, who were a hundred meters from the restaurant when the murder occurred, had, among other things, procured the murder weapon, mapped out the victim, and afterwards burned the clothes used in the shooting.
Their actions were so central that, according to the prosecutor, they should be considered as accomplices and convicted of murder, which the Norrköping District Court agreed with and sentenced to life imprisonment.
However, the Göta Court of Appeal believes that it has not been proven that the two men handled the murder weapon or that they mediated contact to the shooter about the 22-year-old's whereabouts. On the other hand, they were aware of the murder plan and burned the clothes after the shooting. Overall, their actions should be assessed as aiding and abetting murder, the Court of Appeal believes.
"Both have, as accomplices, played a central role in the execution of the murder, even though neither of them fired the shots that killed the victim," writes the Göta Court of Appeal, which sentences them to 12 years in prison.
