Two people, a woman and her daughter, died when the cargo ship Misje Verde collided with a pleasure boat in late July. The father and son in the family were seriously injured but survived.
At the end of September, the captain and pilot aboard the freighter were convicted of negligence in maritime traffic causing death and bodily harm.
Both the pilot and the captain have appealed the verdict.
On Wednesday, prosecutor James von Reis announced that he would not appeal the district court's verdict. He said the chances of securing a harsher sentence were too slim.
The pilot has sought to postpone further proceedings, which James von Reis says he will oppose.
