When the police could not find his cell phone during a visit to a gym, they suspected a man of stealing it and conducted a quick body search. They found no phone on him; it was later found in the gym. The man who was searched has a disability that affects his communication skills, among other things.
Both the district court and the court of appeal found that the suspicion of theft rested on very weak grounds and that there was no legal basis for the search. The police officer is therefore sentenced for misconduct in office and to a 30-day fine.
