A request for his release has been sent to the Oslo District Court, Høiby's lawyer Ellen Holager Andenæs tells Aftenposten.
The request will be handled in writing. It is not clear at this stage on what grounds it is justified.
Marius Borg Høiby, 29, is the son of Norway's Crown Princess Mette-Marit. He is on trial on 40 charges, including assaulting a former girlfriend and four counts of rape.
Høiby was arrested the day before the trial began after he was suspected of further violence, threats and violation of a restraining order. Two charges related to this have been added during the ongoing trial. In court, he has admitted to some charges but denied the rape charges.
Corrected: A previous version gave the wrong number of charges Marius Borg Høiby is facing.
