When the Supreme Court increases the damages, the amount is significantly higher than what the district court and the court of appeal previously decided.
The man, who is now 87 years old, lived under guardianship for a year before it ceased. The Supreme Court finds that he was placed under guardianship without grounds for it and that the handling had several serious flaws.
"To completely lose the capacity for self-determination under such circumstances constitutes a very serious violation of the individual's self-determination and dignity and a breach of the right to private life according to Article 8 of the European Convention", writes the Supreme Court.
"I lost control over my own life. Nothing can compensate for what I was forced to go through, but for me, the verdict is an important redress and a recognition of what the state has subjected me to", says the man in a press release from the Centre for Justice.
