The woman reported the man in December 2022, and he was sentenced to ten months in prison for negligent rape in the district court. However, the Court of Appeal acquitted the man because it could not be proven that the woman did not want to participate in the strangulation, or that the strangulation had been severe.
The Attorney General believes that the man should be sentenced to at least ten months in prison.
"The man's failure to ascertain whether the woman wanted to participate in sexual intercourse that included violent elements in the form of strangulation must be considered reprehensible," says Attorney General Katarina Johansson Welin in a press release.
