Man acquitted of aggravated drunk driving despite 2.8 per mille blood alcohol level

A man in his 50s charged with aggravated drunk driving was acquitted by the district court, despite having a blood alcohol level of 2.8 per mille, reports P4 Jämtland.

It was in September in the municipality of Östersund that a shop assistant alerted police after a man drove away in a car, appearing noticeably drunk as he staggered and fumbled with the car keys.

The man, who was not tested until 1.5 hours later at his home, said he had drunk a bottle of vodka after getting home but had been sober during the journey.

Although he was found to have a blood alcohol level of 2.8 per mille, and there is substantial evidence that he drove while drunk, the district court believes it has not been disproved that he drank only after getting home.
