"The Court finds it established that the accused can effectively exercise his rights to a fair trial during the proceedings," the ICC writes after reviewing the independent assessors' statement on the 81-year-old Duterte.
The trial is scheduled to begin on November 30.
Duterte is facing three counts of crimes against humanity at the ICC. The charges relate to killings allegedly committed as part of Duterte's crackdown on drug users and dealers during his presidency from 2016 to 2022.
Duterte's lawyers have also previously argued that the court does not have jurisdiction over crimes in the Philippines because the country is no longer covered by the Rome Statute, the ICC's founding document.
