Khan's case will be heard by the Assembly of States Parties (ASP), the body representing all ICC member states, and, pending that decision, he has been suspended.
The decision has little impact in practice, as the 55-year-old Khan voluntarily stepped aside in May 2025 to fight the charges, which he denies.
The ASP will convene as soon as possible to discuss the case, according to a statement.
