HD dismisses Falcon Funds case

The Supreme Court (HD) does not grant leave to appeal the Court of Appeal ruling that acquitted the state for the actions of the Swedish Pensions Agency in the so-called Falcon Funds affair. The plaintiff is considering taking the case to the European Court of Justice.

In the case, people behind Falcon Funds are said to have siphoned billions of dollars out of the pension system using forged documents.

The case that has now been dismissed by the Supreme Court concerns the lawsuit that Daniel Edencrona filed to receive compensation from the state for losses he incurred in the case.

Both the district court and the court of appeal have previously exempted the state from liability for compensation.

"This is very regrettable news for Swedish pension savers. The decision means that it is the savers – and not the state – who will have to take the blame for the serious shortcomings in the Pensions Authority's system. We are now considering taking the case to the European Court of Justice," says Erik Scherstén, lawyer at the Center for Justice and representative for Daniel Edencrona.
