Chief Judge Graciela Gatti Santana has requested a full account of the circumstances surrounding Kabuga's death.
Businessman Kabuga, one of Rwanda's richest, was arrested in Paris in 2020. He was accused of contributing in various ways to the genocide in which hundreds of thousands of Tutsis and moderate Hutus were murdered.
The court found in 2023 that Kabuga was unable to complete the trial due to faltering health.
In addition to having contributed financially to the founding of armed groups and to radio and television channels that spread hateful messages, Kabuga is accused of having purchased large quantities of machetes, which were then distributed to militias.
