The Boston-based court does not believe that the Trump administration has been able to prove that Harvard has engaged in discrimination based on ethnicity, nationality or other grounds.
When the lawsuit was filed in March, the US Department of Justice alleged that the university failed to protect the civil rights of Israeli and Jewish students in connection with pro-Palestinian protests on campus.
The legal battles are part of Trump's feud with Harvard, and stem from the university's refusal to accept demands for, among other things, government oversight of admissions, hiring practices and political affiliations. Other universities are also in the crosshairs.
