The British pop star Ed Sheeran is once again cleared of allegations that his song "Thinking out loud" is a plagiarism of Marvin Gaye's soul classic "Let's get it on".
This time, it is an appeals court in New York that has come to the conclusion that the songs only share the "fundamental musical building blocks" and that it therefore cannot be seen as song theft, writes Rolling Stone.
"Overprotecting such fundamental elements would threaten to stifle creativity and undermine the purpose of copyright law", the court writes in its decision.
The lawsuit was filed by Structured asset sales, a company that owns 11.11 percent of the rights to "Let's get it on". In May, a civil lawsuit was settled in Sheeran's favor, where he was accused of plagiarism by the heirs of Ed Townsend, who co-wrote the hit song with Marvin Gaye in 1973.
