Svea bank is prohibited from charging unclear late fees on white loans, according to a verdict in the Patent and Market Court.
The question that has now been tried concerns whether the late fee disrupts the balance between the borrower and the lender, since the fee is charged without the amount being clearly stated in the agreement, according to the Consumer Agency.
"We are pleased that the court shares our view on the unfairness of the current contractual term regarding late fees", says Assistant Consumer Agency Director Kristofer Johannesson in a press release.
On the other hand, late fees in themselves do not have to be unfair, according to the court.
