The man was controlled in the western parts of Karlstad during the afternoon and exceeded the limit in the evidence instrument. He is also suspected of gross unlawful driving. The car he drove has been seized in accordance with TBL§7.

Facts The Law on Penalties for Certain Traffic Offenses (1951:649)

7 §   A vehicle that has been used in an offense under this law may be declared forfeited, if it is necessary to prevent continued such offenses and forfeiture is not obviously unreasonable. The same applies to other property that has been used as an aid in an offense under this law.

If someone has committed unlawful driving, drunk driving or gross drunk driving, it should be particularly taken into account in the assessment of whether forfeiture is necessary to prevent continued offenses if the offender has previously committed such offenses.
