The driver, a woman who lacks a driver's license, is allowed to accompany for sampling and interrogation after suspicion of drunk driving. She is also suspected of gross unauthorized driving.

The car is seized with the support of the Traffic Offenses Act 7§. This means that a vehicle used in a crime can be declared forfeited, if it is necessary to prevent further such crimes and the forfeiture is not obviously unreasonable.
