The ruling concerned a case where a young person was suspected of and subsequently detained for very serious crimes. The Administrative Court and the Court of Appeal held that the suspected crimes were grounds for taking the person into custody under the LVU, which is also the view of the Supreme Administrative Court.
It was noted that the preparatory work for the LVU or its predecessors did not state that a conviction in a criminal case was required to justify compulsory care.
The young person in question was then acquitted on all charges.
