Indefinite Sentences for Dangerous Offenders Proposed for Spring 2026

The Government proposes that particularly dangerous individuals from 1 March 2026 may be sentenced to imprisonment for an indefinite period. The new time-indeterminate penalty is called security detention.

”Some offenders are so dangerous to the surrounding society that they should not be released automatically”, writes Minister of Justice Gunnar Strömmer (The Moderate Party) and representatives of the other Tidö parties in a debate article in Expressen.

They point out that today there is no possibility to continue detention even if the risks of new serious crimes after release are very high.

The legislative proposal, a council on legislation, means that security detention can be sentenced for persons who have relapsed into serious violent and sexual offenses or, for example, arson, and who are considered to have a high risk of committing such crimes again.

It can also be sentenced if a person is convicted of several very serious crimes at the same time, resulting in at least six years in prison.

Security detention means that the court first determines a minimum period to be served in prison, equivalent to a regular prison sentence. In addition, a framework period of between four and six years must be determined.

The framework period can then be extended by up to three years at a time if it is deemed absolutely necessary to protect society. A decision on extension must be made by the court after the National Board of Forensic Medicine has conducted a risk assessment.

Conditional release may not occur from security detention. The court may, however, decide on permission for conditional release after the minimum period has been served, which means that the convicted person is allowed to stay outside the institution with special support and under control.

Persons under 18 years of age may not be sentenced to security detention.
